• Immunity

From IB Joe@1:342/201 to All on Fri Apr 26 16:00:46 2024
Doug In Exile posted, I think one of the best, explanations about the controversy over presidential immunity.

    https://youtu.be/yOviMPGLk20?si=ZoAos3wqdMjBntLI

Perplexing... I heard an argument last night where the person was saying that a president has total immunity during their presidency. Total meaning both personal and criminal liability.

He supported his claims with the Federalist Papers and he made a strong argument, in my opinion.

He did address the criminal side of immunity simply with impeachment. Once impeached the president is open to criminal prosecution.

So we can look at the current president... He cannot be held liable for the open border... People can't sue him for human trafficking and the crime wave that has come from his open border policies... Lets just say Joe wanted to accelerate the lawfare and other unconstitutional stuff he's doing against Trump and he gets a gun from his son Hunter... Tries to shoot Trump and misses... mainly because he forgot what he was doing....

So, with with I heard last night... Joe would be impeached for that act... removed from office and held to account. That seems reasonable.

I do feel the Supreme Court is going to put an end to Jack Smith ambitions to take the orange man down.

We'll have to see. If the presidents don't have immunity there is a lineup of lawsuits against Obama, Clinton and Bush...

Well no, he never "opened" the border.

People can't sue him for human trafficking and the crime wave that

True, Joe was never involved in human trafficing.

They took away many of the rights women have had for over fifty years so I wouldn't be surprised what they do next.

I don't think SCOTUS is going to be much help to ol' Donnie at this point.

We'll have to see. If the presidents don't have immunity there is a lineup of lawsuits against Obama, Clinton and Bush...

Presidents have never had immunity before and have had no trouble.

Ol'e Donnie of course is the exception. He's acted like he had some kind of immunity all along, but of course he has none.

On 26 Apr 2024, Alan Ianson said the following...

    Really? What about Nixon?

You missed the point... Again.... They argued this... Nixon should have been impeached for his non-official act of breaking into the Democrat HQ.... Bla
Bla Bla. Operative thing in your example... I assume Watergate is what you meant with Nixon... NON-OFFICIAL.

Impeach the man in the House, have a trial in the Senate... Senate convicts
and removes him... And he's now open for Criminal persecution, post impeachment.

In Nixon's case he stepped down as president before he could be impeached... and the president Ford pardoned him of any and all things related to the offense.

This would have been a perfect case the constitution... But it was thwarted
    by pardons and whatnot.

BTW, Watergate was an inside CIA job to get rid of Nixon because he told the CIA that he knew who killed Johnny, AKA JFK.

Well no, he never "opened" the border.

Yes he did... He said come on up... you'll get free phones and stay at 5 star hotels and whatnot... There is a stronger argument that Biden opened the border up than Trump was guilty of campaign finance law issues over paying a porn star not to talk about a BJ she may or may not gave him.

True, Joe was never involved in human trafficing.

He enables it... Maybe they are paying the Big Guy 10%... Joe can send the military to the border tomorrow and shut the border down but he doesn't

Its also reported that Biden has lost over 80,000 some odd kids and since he stopped DNA testing they have not clue who they are giving the kids over to.

Lawfare? What is it about law and order that you hate so much?

you need to stop watching MSNBC, or Global...

That, like everything MAGA is completely unreasonable.

The US is a Republic. It is suppose to have the Constitution and the rule of law.

They took away many of the rights women have had for over fifty years so
I wouldn't be surprised what they do next.

They didn't take any rights away... They pushed it back to the States where
it belonged ... 10th Amendment says so...Ruth Bader Ginsburg, the Supreme
Court Justice that passed away was on record stating that Roe was not on sound ground.

    Ginsburg quote...

"No less than Kate Michelman, then head of the National Abortion Rights Action League, was worried. "Her criticisms of Roe raise concerns about whether she believes that the right to choose is a fundamental right or a lesser right," Michelman said."

She believed that Roe should have been codified in congress. There is
nothing in the constitution about women's right to kill their babies. She believed an activist court, at the time, over reached. It's place as a president was weak.

Bader Ginsburg also argued as Roe stood it was more about a doctor being able to do abortions than it was about a woman's right to choose.

BTW, Obama could have passed any law he wanted... He could have easily passed something on this. He had the House and over 60 senators... Did he do it... No... they just like the fight every 2 years on abortion.

Democrats would rather see the country divided on this issue than have women with the right to choose.

As we see today with the Trans stuff what the Democrats feel about women's rights.

I don't think SCOTUS is going to be much help to ol' Donnie at this
    point.

Sorry... I heard some of the questioning... And I think it's going in Trumps favor. Like usual you post nothing to support this claim. At least I posted some clips where the justices are asking questions or their questioning is being analyzed...

How did you come to this conclusion... Please persuade me... Unlike the left I'm open to hear some new ideas.

Presidents have never had immunity before and have had no trouble.

They've all had immunity... Lincoln suspends Habeas Corpus... nothing... Roosevelt... sent Japanese to interment Camps... nothing... Truman bombed Japanese citizens... NOT MILITARY... CITIZENS... when he dropped 2, not 1 but 2 nuclear bombs... nothing... During the current Supreme court questioning the court brought up Operation Mongoose... JFK/CIA stuff with Cuba and the bay of pigs ... Carter... He did something... I know it... Regan did nothing he was perfect... Clinton got a BJ ... George W lied to congress and the American people ab out Weapons-Of-Mass-Distruction in instigate a conflict where it needed to not go. A few days back I wrote a message wrote a message saying that 6 out of the 11 times war was approved by congress happened during the second world war... This means Roosevelt didn't take the original authority he received for Japan and and used that to expand the conflict... He went back to congress to seek more approval. Every conflict since WWII that the US was involved in since WWII was unconstitutional is someway. Obama killed American citizens in drone strikes.

And YES... Trump told people that they had a 1st amendment right to go peacefully and let congress know how they feel.

Now... I hadn't finished my coffee and this is what I came up with...

They do have a strong record of chaos and disorder.

Not when it comes to policing the president. They do nothing while Biden's lawlessness kills thousands of people and puts American life on the line.

Why did the GOP kill the border deal?

The GOP (and MAGA) don't care about the border.

I hope that was more in line to your question on Nixon.

You make the same silly argument that DT and his lawyers make before SCOTUS.

These are arguments that are constitutional.

A president may well be impeached or not. The success of impeachment depends on the dutifulness of the congress/senate.

That's right... There has to be strong enough evidence to convict.

The GOP doesn't have a strong record for law and order.

Please site some evidence on this....

A president who commits a crime could/should/would be charged with any crimes committed regardless of impeachment.

Then we can start with charging Clinton, Bush and Obama... We can start with Obama for killing and American without due process.

And... I am confused... What crime did Trump commit??

An impeachment and a trial are two different things. Impeachment removes
a bad actor from office. An indictment of crimes will result in a trial. If convicted of any crimes the criminal will have to pay fines or do
time in prison depending on the outcome.

No... Maybe in the Canada your leader would pay a fine... This is the process in the US. If they had impeached Obama for the murder of a citizen... There could be a prosecutor or AG say no prosecutor would prosecute the case like Comey did with Hillary...

There is a constitution in the US... There is suppose to be laws... So.. You could impeach... and the Senate may not convict. The Senate could convict and all they give is a stern talking to... A partisan AG, in whatever jurisdiction could not advance it any further than the stern talking to.

The GOP killed the best border deal made that was ready to be signed.

Sorry., Biden by killing Trump's border policies. But then again... I say let Biden run on his policies .... They seem to be working...!!! Biden and his supporters must be sick of winning!!!

They didn't loose anything, period. Roe should not have been a legal president to work with. The constitution was the final arbiter of that.

Here's a fact or 2. More babies were murdered in 2023 than any year prior, more, not less. As we stated last week... a so-called Christian Conservative Republican funded late-term abortion... last bill... And the US pays to abort babies in the Mexico.

You need to read the 10th Amendment and get back to us.

It's a States Rights issue... Some States you can kill you baby in the 9th and 10th month and others you may have to do it in the 1st trimester... kinda where normal people might seek out that treatment.

"Trans stuff" has nothing to do with women's rights.

Yes it does... They are squashing everything women have worked for this far... Ohhhh and I will give you this... If your Trans you can have all the abortions you want... The doctor may need assistance with a nurse to hold your testicles aside while they vacuum out your man-gina.

Sure, Japan attacked the US and the US responded. Any questions?

you missed a major point... The president at that time went to congress for approval each and every time that war was escalated. The last time the US was in a conflict that jives with the constitution was then. Nothing since... and we shouldn't be fighting them bi-proxi either.

MAGA does not care about the constitution or the rule of law.

Where is the support on this?? Please site some examples so as I can better understand your claims.

Fact. The GOP killed a border deal negotiated by a republican who wanted action on the border. The president supported and wanted to sign the deal.

Donald Trump wanted talking points for the election, a narrative, and republicans (MAGA) gave it to him.

I hope that fact is not too hard for you to follow.

They sure did. Women in the USA have lost the right to privacy and to
    make their own choice.

    They didn't loose anything, period.

A bold statement. Inaccurate, but bold.

Roe should not have been a legal
president to work with. The constitution was the final arbiter of that.

Amy Coney Barret and Brett Kavanaugh both said that Roe v Wade was precedent, settled law at their hearings.

Here's a fact or 2. More babies were murdered in 2023 than any year prior, more, not less. As we stated last week... a so-called Christian Conservative Republican funded late-term abortion... last bill... And the US pays to abort babies in the Mexico.

    That's just the MAGA narrative.

Women are and will continue to be harmed by these kind of policies.

You need to read the 10th Amendment and get back to us.

It's a States Rights issue... Some States you can kill you baby in the 9th and >10th month and others you may have to do it in the 1st trimester... kinda wher
normal people might seek out that treatment.

You are confused. States rights are not the same as women's rights.

A woman should be able to get the care she needs at all times. There is no need or place for lawyers, judges or law makers in any of that.

The border deal sounded like a bad deal to me. I'm glad that they didn't vote for it. I'm not into fixing things with a band aid. I want a deal that includes border wall construction, mass deportations, and increased penalties for participating in illegal immigration.

The GOP don't care about the border, but MAGA cares. A limit on illegal immigrants allowed per day is stupid. It's like putting a limit on the number of murders your allowed to do per day. 1 is too many!

    silly.

In what way are they unconstitutional??? Site an example and where in the constitution do they lack?

Here's a small example for you..

The constitution does not give a president the right to break the law and then claim immunity.

As I stated earlier, the GOP "impeachment" of Joe Biden without a crime.

There has been no impeachment of Joe Biden thus far...

Jim Jordan, the house judiciary chair (the man is not a lawyer, he never passed the bar!) along with house oversight committee chair James Comer have declined or stopped investigations into Donald Trump and have been leading an investigation into what fox news calls "the Biden crime family".

OK, well lay your charges if you think you have any.

I have given you facts, you don't/won't/can't see them.

Sir, that's how convince someone that your point is valid.

I do not want or need to convince anyone.

Amy Coney Barret and Brett Kavanaugh both said that Roe v Wade was
precedent, settled law at their hearings.

Nobody lost a right... as I said before the baby killing machine is stile aliv

Are you blaming the woman? I am sure you know a woman can't become pregnant on her own.

    Hello Alan,

    [..]

Roe should not have been a legal president to work with. The constitution
was the final arbiter of that.

Amy Coney Barret and Brett Kavanaugh both said that Roe v Wade was precedent, settled law at their hearings.

They lied. Both of them. Not only did Brett Kavanaugh say he liked
beer, but he also said that he was not an alcoholic. As well as not
a rapist. And Amy Coney Barret backed him up, saying she was not and
has never been anybody's handmaiden ...

Here's a fact or 2. More babies were murdered in 2023 than any year prior,
more, not less. As we stated last week... a so-called Christian
Conservative Republican funded late-term abortion... last bill... And the
US pays to abort babies in the Mexico.

    That's just the MAGA narrative.

Where are all these baby graves to be found? Infanticide is not
practices anywhere in the USA, or in Mexico. Maybe it is elsewhere,
in the dark regions of ones own mind. But nowhere else that I can
    think of.

Women are and will continue to be harmed by these kind of policies.

Outlawing medical tools and techniques used by doctors and nurses
violate the very oath health professionals are sworm to keep - first
    do no harm.

So who are the murderers? The politicians who insist on forcing
women who have been raped to give birth against their own will in
order to save the life of a rapist who deserves to be executed for
his crimes? And to be forced to pay for the needs and wants of that
child she never wanted in the first place? Talk about sick ...

If those so-called "pro-life" politicians are truly "pro-life" they
would be opening their own pocket books to pay for all the wants and
needs of both the mothers and babies of the hoodlums who raped them.
But we all know that will never happen. Not in this world, or the
    next.

You need to read the 10th Amendment and get back to us.

It's a States Rights issue... Some States you can kill you baby in the 9th
and 10th month and others you may have to do it in the 1st trimester...
kinda wher normal people might seek out that treatment.

You are confused. States rights are not the same as women's rights.

Confused? Not at all. Here is the full text of AMENDMENT X -

The powers not delegated to the United States by the Constitution,
nor probibited by it to the States, are reserved to the States
    respectively, or to the people.

I had a professor in college who had fun with this issue. Some of the
more conservative students were trying to use the 10th amendment as an
excuse to be able to do whatever the heck they wanted, claiming it was
states rights and not a matter for the feds to decide.

The professor was from Rochester, New York. He answered the students
questions with a question of his own -

    "What are those rights?"

None of the students could provide him an answer.

A woman should be able to get the care she needs at all times.

The first of all human rights is access to quality health care.
Whenever that quality of health care is diminished, or eliminated,
it is a denial of our own very right to existence. As well as our
    posterity.

There is no need or place for lawyers, judges or law makers in any of that.

If the first of all human rights does not exist, nothing else
    really matters.

    For Life,
    Lee

    Don't ask stupid questions...

Women in the US have lost some basic rights and it is hurting them.

Women haven't lost a thing... Abortions are still happening, at a record rate, and being funded by the government.

Roe was not about the woman's right to choose as it was for a doctor's ability to perform the procedure.

Are we talking about a women's rights, or states rights?

Democrats had a chance to codify Roe... They didn't and it was pushed back to the state. The only thing that has changed is that some States say you can't kill the baby in the 2nd or 3rd term of the pregnancy... unless there is an issue with the mother's life.

In the US there is only a small percentage of people who believe you should kill a baby in the 8th, 9th and 10th month. Whereas the support for abortion increases to ~70% if it's done in the first trimester.

Each state get to chose what they want... People of that state can make themselves heard... And if your a woman that uses abortion as a form of birth control you may have to move to a different state or kill your baby in the 1st trimester.

Are you blaming the woman? I am sure you know a woman can't become pregnant on her own.

They are the ones who get pregnant. I say that they should stop taking risks...
