    It should be reminded to all about all the complaints
    about systematic cheating by Home Owner Associations,
    local and state governments have been requiring HOAs
    to be set up by builders of developments as a condition
    for the permit to build. So errant states like Hawaii
    and Florida, and rogue cities like Houston Texas,
    require HOAs as a matter of policy, by force, and not
    by a free choice of the marketplace.

    The residents can always just dissolve the HOA themselves if they don't want it.

    What do you mean when you say the roads are not "dedicated"? Is that a
    synonym for "publicly owned"? In my area - and I dare say most of Canada
    - the roads *are* publicly owned meaning that the municipality is
    responsible for maintaining them in the sense of fixing potholes or
    shovelling snow.

    It can be but it varies, sometimes the city owns the
    streets, but usually it is the property of the HOA,
    and the state won't allow dissolution unless it agrees
    to maintain the private roads, which is obviously not
    likely when that same government is requiring that
    all new developments must be governed by HOAs.

    If they won't allow dissolution of the HOA, the HOA members could just vote to release all the deeds of title of the various homes from the HOA's deed restrictions.

    The HOA would still technically exist, but the individual homeowners would not be obligated to follow its decrees.

    A master developer buys rural land on the outskirts of suburbia. He
    creates subdivisions, which literally means establishing lot lines and
    rights of way for roads and utilities on a plat. Portions are sold to
    other developers who will build homes, utilities, and roads.

    If the roads are to be maintained by government, then the rights of way
    need to be 50' or 60' wide to accomodate on-street parking, as every
    fire department demands paved width of 36' to be able to drive between
    parked cars.

    Once all permits are complied with and there is final inspection
    approval, the developer dedicates the rights of way to the government
    that will maintain it.

    If there's an HOA, then the rights of way can be narrower and more
    housing may be built. It can then be more profitable.

    We had a developer here that I did some contract work for who was so
    concerned about porn that he would stay in the office during lunch to go through people?s desks to make sure they didn?t have Playboy magazines. He built a subdivision where the HOA had rights to come into your home at any point and search for porn, it didn?t hold up and he eventually went to
    prison on unrelated charges.
